Nevermind LLC ("we", "us", "our") is committed to protecting the personal information of everyone who visits nevermind.ae or interacts with us online. This Privacy Policy explains what data we collect, why we collect it, who we share it with, and your rights in relation to it.

Please read this Policy carefully. By using our website or submitting your details through any of our forms, you acknowledge this Policy.

1.  WHO WE ARE

Nevermind LLC is a Limited Liability Company incorporated in the Sharjah Media City Free Zone, UAE (Trade License No. 2539903). We are a creative studio specialising in branding, advertising, digital marketing, and AI-assisted brand tooling.

2.  WHAT INFORMATION WE COLLECT

2.1  Information You Provide Directly

We collect personal data when you:

• submit a contact or project enquiry form on nevermind.ae;

• sign up for our email newsletter or mailing list;

• send us an email or reach out via social media; or

• share files, briefs, or materials as part of a potential or active engagement.

The types of data collected include: name, email address, phone number, company name, job title, and the content of your message or brief.

2.2  Information Collected Automatically

When you visit nevermind.ae, we and our analytics tools automatically collect:

• IP address (anonymised where possible);

• browser type, device type, and operating system;

• pages visited, time on page, and referring URL;

• cookie identifiers and session data (see Clause 6).

2.3  Information from Third Parties

We may receive information about you from third-party platforms such as LinkedIn or Instagram if you interact with our content or message us through those channels.

3.  HOW WE USE YOUR INFORMATION

We use your personal data for the following purposes:

• To respond to your enquiries and provide information about our services;

• To prepare and send proposals, contracts, and project communications;

• To send newsletters, updates, and marketing communications where you have opted in (see Clause 5);

• To manage our client relationships using HubSpot CRM;

• To analyse website performance and improve the user experience via Google Analytics;

• To comply with applicable UAE legal and regulatory obligations; and

• To protect our legitimate business interests, including enforcing agreements and preventing fraud.

Our lawful bases for processing are: (a) your consent, where obtained (e.g. email sign-up); (b) performance of a contract or pre-contractual steps; (c) compliance with legal obligations; and (d) our legitimate interests, where these are not overridden by your rights.

4.  THIRD-PARTY PROCESSORS

We use the following trusted third-party tools and platforms to deliver our services. Each is bound by its own privacy and data processing terms. We have selected these tools on the basis of their data protection standards.

We do not sell, rent, or trade your personal data to any third party. We may also share data where required by UAE law, court order, or regulatory authority, or in connection with a merger, acquisition, or restructuring of Nevermind LLC (subject to appropriate confidentiality protections).

5.  EMAIL MARKETING AND OPT-OUT

If you sign up for our newsletter or email list, we will use your name and email address to send you updates, insights, and occasional marketing communications. We use Mailchimp to manage and send these communications.

You can unsubscribe at any time by clicking the unsubscribe link in any email we send, or by emailing manav@nevermind.ae. Unsubscribing from marketing emails does not affect transactional communications related to an active engagement.

6.  COOKIES

6.1  What Are Cookies

Cookies are small text files stored on your device when you visit a website. We use cookies and similar technologies to make nevermind.ae function correctly and to understand how visitors use the site.

6.2  Types of Cookies We Use

• Essential cookies — necessary for the site to load and function. These cannot be disabled.

• Analytics cookies — set by Google Analytics to help us understand traffic patterns and page performance. These are anonymised where possible.

• Marketing / tracking cookies — set by HubSpot to track form submissions and website activity linked to your contact record, enabling us to follow up effectively.

6.3  Your Cookie Choices

You may manage or disable non-essential cookies through your browser settings. You can also opt out of Google Analytics tracking via the Google Analytics Opt-out Browser Add-on (tools.google.com/dlpage/gaoptout). Disabling cookies may affect some website functionality.

We will implement a cookie consent banner on nevermind.ae in accordance with applicable requirements. Until then, by continuing to use the site after reading this Policy, you acknowledge the use of cookies as described above.

7.  DATA RETENTION

We retain your personal data only as long as necessary for the purposes set out in this Policy:

• Enquiry and contact form data: up to 2 years from last contact;

• Newsletter and email list data: until you unsubscribe, plus 30 days for system propagation;

• Client project and contract data: up to 5 years from project completion (for legal and contractual record-keeping);

• Analytics data: per the retention settings of the relevant tool (Google Analytics default: 14 months; HubSpot: per account settings).

After the applicable retention period, data is securely deleted or permanently anonymised.

8.  YOUR RIGHTS

Subject to applicable UAE law, you may have the right to:

• access the personal data we hold about you;

• request correction of inaccurate or incomplete data;

• request deletion of your personal data (subject to our legal retention obligations);

• object to or restrict certain processing;

• withdraw consent at any time where processing is based on consent, without affecting the lawfulness of prior processing.

9.  DATA SECURITY

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, alteration, or disclosure. These include access controls, encrypted communications, and use of reputable third-party platforms with strong security standards.

No method of transmission over the internet is completely secure. While we take all reasonable precautions, we cannot guarantee absolute security and we encourage you not to share sensitive personal information unnecessarily through website forms.

10.  AI TOOLS

Nevermind LLC uses AI-powered tools (including Anthropic's Claude platform) in the delivery of certain services. We do not input sensitive personal data into AI systems without appropriate client consent and safeguards. Any data processed through AI tools is used solely for the purpose of delivering the agreed services and is not used to train third-party AI models unless explicitly permitted.

11.  INTERNATIONAL DATA TRANSFERS

Nevermind LLC is based in the UAE. Our third-party processors (Google, HubSpot, Mailchimp) may process data on servers located outside the UAE, including in the United States and European Union. These transfers are made on the basis of the processors' standard contractual frameworks and privacy certifications.

Clients based in India should note that the Digital Personal Data Protection Act 2023 (DPDP Act) may impose obligations on them as data fiduciaries when sharing personal data with us. Indian clients are responsible for their own compliance under applicable Indian law.

12.  CHILDREN

nevermind.ae is not directed at children under 18. We do not knowingly collect personal data from minors. If you believe a minor has submitted data to us, please contact us and we will delete it promptly.

13.  CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. The revised version will be posted on nevermind.ae with an updated effective date. Where changes are material, we will take reasonable steps to notify active clients and newsletter subscribers.
