TERMS OF SERVICE

1.  ACCEPTANCE OF TERMS

By accessing or using the Nevermind LLC website at nevermind.ae, requesting a proposal, or engaging with any Nevermind LLC digital touchpoint (collectively, the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

These Terms apply to all visitors, prospective clients, and any person accessing the Site.

2.  ABOUT NEVERMIND LLC

Nevermind LLC is a Limited Liability Company incorporated under the laws of the United Arab Emirates and registered with Sharjah Media City Free Zone, Trade License No. 2539903. Nevermind LLC provides branding, advertising, digital marketing, corporate identity, website development, video production, and AI-assisted brand tooling services.

3.  SERVICES AND ENGAGEMENTS

3.1  The Site provides information about Nevermind LLC's services. It does not constitute an offer to provide services. All service engagements are governed exclusively by a separate written Service Provider Agreement signed by both parties.

3.2  Any proposals, scope documents, or quotations provided by Nevermind LLC are indicative only and do not constitute binding commitments until formalised in a signed agreement.

3.3  Nevermind LLC reserves the right to decline any engagement at its sole discretion and without obligation to provide reasons.

4.  INTELLECTUAL PROPERTY

4.1  All content on the Site — including but not limited to text, graphics, logos, images, case studies, portfolio work, and code — is owned by or licensed to Nevermind LLC and is protected under applicable intellectual property laws.

4.2  You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any Site content without prior written consent from Nevermind LLC.

4.3  Nothing in these Terms grants you any licence or right in respect of the Nevermind LLC name, logo, or brand assets.

4.4  Nevermind LLC's proprietary methodologies, prompt architectures, AI tooling frameworks, and operational processes ("Nevermind LLC IP") are trade secrets and confidential property of Nevermind LLC. Any attempt to reverse-engineer, replicate, or exploit Nevermind LLC IP is strictly prohibited.

5.  USER CONDUCT

By using the Site, you agree not to:

  • use the Site for any unlawful purpose or in violation of applicable laws;

  • transmit any harmful, offensive, defamatory, or infringing content;

  • attempt to gain unauthorised access to any part of the Site or its underlying systems;

  • scrape, harvest, or collect data from the Site without prior written consent;

  • use automated tools (bots, crawlers) to access the Site in a manner that degrades its performance; or

  • impersonate Nevermind LLC or any of its personnel.

6.  THIRD-PARTY LINKS AND TOOLS

The Site may contain links to third-party websites or reference third-party tools and platforms. Nevermind LLC is not responsible for the content, privacy practices, or availability of third-party sites. Links do not constitute endorsement.

7.  DISCLAIMER OF WARRANTIES

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Nevermind LLC does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

8.  LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Nevermind LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site, even if Nevermind LLC has been advised of the possibility of such damages. Nevermind LLC's aggregate liability in connection with the Site shall not exceed AED 500.

9.  INDEMNIFICATION

You agree to indemnify and hold harmless Nevermind LLC, its manager, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Site or breach of these Terms.

10.  GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the United Arab Emirates. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Dubai Courts. The Parties shall first attempt good-faith resolution within 30 days of a dispute arising before commencing formal proceedings.

11.  CHANGES TO THESE TERMS

Nevermind LLC reserves the right to update or modify these Terms at any time without prior notice. The revised Terms will be posted on the Site with an updated effective date. Continued use of the Site following any changes constitutes acceptance of the updated Terms.
